These Domain Registration Terms apply to every domain you register, renew, transfer or manage through BIGBANG ITS FZE (“BIGBANG”, “we”, “us”), and are read with our Terms of Services and Refund Policy, which continue to apply.
1. Our Role
- We act as a reseller: BIGBANG resells domain registration services provided by accredited third-party registrars.
- Registrant and account holder: The domain is registered in the name of the registrant you give us, who holds the rights and obligations attached to it; you remain responsible to us for the account, your instructions and all fees.
- An order is not a registration: Your order is a request to register. Registration exists only when the registry confirms it, and availability can change beforehand.
2. Your Account and Registration Data
- Eligibility: You must be at least 18 years old, as our Terms of Services state, and authorised to act for the named registrant.
- Accuracy: You must give complete, accurate registrant, administrative, technical and billing details, including a working email address and phone number, and keep them current.
- Verification: A registry or registrar may require verification of your details, identity or eligibility within the period it states; unreachable data or an unanswered request may lead to suspension or cancellation, with no refund.
3. Registry, ICANN and Registrar Rules
- Rules that bind you: Every domain is subject to its registry’s rules, the accredited registrar’s registration agreement and, for generic extensions, ICANN policy, which may change without our involvement.
- Mandatory instructions: Where a registry, registrar, ICANN, a dispute-resolution provider or a competent authority instructs us to lock, suspend, transfer or delete a domain, we act on it without breach of these terms.
4. Term, Renewal and Auto-Renewal
- Registration period: You may register a domain for 1 to 10 years, where the extension allows it.
- Renewal: You must ensure the renewal is ordered and paid before expiry. Any reminder we send is a courtesy, not a guarantee of renewal.
- Auto-renewal and price: Where auto-renewal is available you may enable it and authorise recurring charges as set out in our Terms of Services. Renewal prices are those applicable at the time of renewal, as shown on your invoice.
5. Expiry, Grace and Redemption
- On expiry: An expired domain stops resolving, and every website, email and service depending on it stops working.
- Registry periods: Some extensions allow a grace period after expiry and then a redemption period against an additional registry fee, and others allow neither; the registry sets both.
- Loss of the name: The registry may then delete, reclaim, auction or resell the domain. We cannot recover a released name, and a domain still shown in your account after expiry is not proof that it remains yours.
6. Transfers In and Out
- Transferring in: Unlock the domain at your current provider, supply a valid authorisation code and keep the registrant email reachable; where the registry allows, a transfer adds a registration period.
- Transferring out: We will not unreasonably withhold a transfer to another provider, but may refuse or delay one where registry, accredited registrar or ICANN rules permit or require it, including non-payment of that domain’s fees, or where the domain is disputed.
- Lock periods and fees: Registries impose lock periods after a registration, a transfer and certain registrant-detail changes, which we cannot waive. Transfer fees are not refundable, including where a transfer is rejected or cancelled.
7. DNS, Nameservers and Use of the Domain
- Management: You control the domain’s DNS records, nameservers and the options the extension supports through our domain management panel; DNSSEC is free of charge.
- Your responsibility: You are responsible for your configuration and for the content and services the domain resolves to; our Acceptable Use Policy applies to every domain we manage.
8. Publication of Registration Data and Privacy
- Publication: Registries and registrars may publish or disclose registration data in public directory services and to third parties. You acknowledge that registry policy and applicable law require this, and you instruct us to submit your data accordingly.
- Privacy option: Where the registry and registrar support it, a domain privacy option may be offered; its availability and any fee are as confirmed by us for your order. It may be suspended, or the data disclosed, where registry rules, a dispute proceeding or a competent authority requires it.
9. Trademarks, Disputes and the UDRP
- Your representation and warranty: You represent and warrant that registering and using the domain infringes no third-party rights and is not for an unlawful purpose or in bad faith.
- Dispute policies: Your domain is subject to the Uniform Domain-Name Dispute-Resolution Policy (UDRP) where the extension applies it, or the registry’s equivalent policy, and you are bound by any decision under it.
- Our position: We are not a party to such disputes and do not arbitrate them; we implement the decision of the registry, the dispute-resolution provider or a competent court, and you bear your own costs and indemnify us under our Terms of Services.
10. Premium, Restricted and Country-Code Extensions
- Premium names: Registries classify some names as premium and price them individually. A premium price we quote applies to that order alone, and renewals may also be at a premium rate.
- Restricted extensions: Some extensions, including country-code extensions such as .ae and other regional extensions, carry registry eligibility conditions and may require supporting documents or evidence of local presence or a licensed activity.
- Documents and refusal: You must supply what the registry asks within the period it allows. We forward the documents, but the decision is the registry’s, which may refuse or later revoke a registration if its conditions are unmet.
11. Fees, Refunds and Cancellation
- Payment in advance: Domain fees are due in advance, and all prices and invoices are denominated and payable in United States Dollars.
- No refunds: Registrations, renewals, transfers, restorations and related registry charges are final and non-refundable, subject only to the narrow exception set out in our Refund Policy.
- Cancellation and disputes: Cancelling stops future billing only and gives no refund for an unused period. A charge-back raised before contacting our billing department may lead to suspension or termination of your services.
12. Suspension, Deletion and Termination
- Grounds: We may suspend or stop supporting a domain on breach of these terms, the Terms of Services or the Acceptable Use Policy, on non-payment, on a registry or authority instruction, or where the domain is used for abuse.
- Effect: A suspended or deleted domain stops resolving and the services depending on it stop working; we cannot reverse a registry’s deletion.
13. Liability and Your Statutory Rights
- No warranty of outcome: Our services are provided “as is” and “as available”. We do not warrant a name’s availability, the acceptance of a registration, renewal or transfer, or any registry timeframe.
- Third-party acts: We are not liable for the acts, omissions, outages or policy changes of a registry, registrar, dispute-resolution provider or competent authority, nor, to the fullest extent permitted by law, for indirect, incidental or consequential damages; the exclusions and limitations in our Terms of Services also apply.
- Mandatory rights: Nothing in these terms excludes or limits any right you have that cannot be excluded or limited under mandatory United Arab Emirates consumer protection law.
