These Business Email Service Terms apply to the business email services BIGBANG ITS FZE (“BIGBANG”, “we”, “us”) provides to the client named on the order or invoice (“you”): shared mailboxes, whether on infrastructure we operate or on a platform we license, per-user licences on your domain, and mailbox migration.
1. Scope and Other Applicable Terms
- Documents that apply together: These terms are read with our Terms of Services, Acceptable Use Policy and Refund Policy: on email matters this document applies, on others those do. Nothing here creates an availability, delivery-time or response-time commitment beyond what your order or quotation states.
- Third-party platforms: Where a mailbox is licensed from a third-party platform and provisioned by us, that provider’s terms also apply; we identify them in your order or on request.
2. Mailboxes, Users and Your Domain
- Per user, and your responsibility: Business email is sold per user, minimum one user, on a domain you own or control; we provision and renew them on your instruction and invoice them with your other services. You are responsible for mailbox security and for all activity carried out through your mailboxes; report unauthorised use immediately and do not share credentials.
- Domain and DNS records: Keep your domain registered; if it lapses, mail stops. Where your DNS is managed elsewhere, publish and preserve the mail and sender authentication records we provide; we are not responsible for failures caused by missing or altered records.
3. Storage and Fair Use
- Storage allowance: Your allowance is stated in the plan you order or in the specification of the licensed platform. A full mailbox may stop receiving mail; timely archiving is your responsibility.
- Shared resources: Mailboxes on infrastructure we operate share resources with other clients; if your use degrades the service for others we may apply the fair usage measures in our Acceptable Use Policy.
4. Acceptable Use and Anti-Spam
- No unsolicited bulk mail: Our Acceptable Use Policy applies to every mailbox. You must not send unsolicited commercial email, unsolicited newsletters or marketing campaigns from any mailbox provided under these terms, whatever the size of the list, nor relay such mail through our systems; on a third-party platform, that platform’s sending rules apply in addition.
- Enforcement: We may warn you, throttle sending, disable a mailbox, suspend or terminate the service and report illegal activity to the authorities, without prior notice where the service is at risk.
5. Consent and Mailing Lists
- What this section covers: This section applies where you are permitted to send commercial messages: individually from a mailbox, or in bulk through an email delivery service ordered separately from us; it permits nothing section 4 prohibits.
- Your responsibility: You are responsible for the lawfulness of what you send: every recipient must have consented or you must otherwise have a lawful basis to contact them, and your lists must not be purchased, rented or harvested; keep consent records and produce them on request within a reasonable period. Every commercial message must identify you accurately, use a sender address you may use and carry a working unsubscribe honoured without undue delay; repeated complaints or spam-trap hits are grounds for suspension.
6. Sending Limits and Filtering
- Sending limits: We may set and change outbound sending limits to protect the service’s stability and sending reputation; those applying to you are stated in your order or notified to you.
- Filtering: We may filter mail for spam, viruses and harmful content, quarantine, delay or reject messages, and block attachment types commonly used to abuse mail systems. No filtering is perfect: legitimate mail may be filtered and unwanted mail may arrive.
7. Compromised Mailboxes and Blocklisting
- Immediate action: If a mailbox is compromised, or threatens the security, performance or reputation of our systems, we may suspend it, reset its credentials, block outbound mail and discard abusive queued messages without prior notice.
- Shared sending reputation: If your use causes an address, domain or hostname we send your mail through to be blocklisted, we may restrict or suspend your sending until it is resolved. We will make commercially reasonable efforts to obtain delisting, but that decision rests with the receiving operators; cleaning your own devices or websites is a separate project quoted in advance; repeated incidents are grounds for termination.
8. Deliverability
Whether a message is accepted, and whether it reaches the inbox or a junk folder, is decided by the recipient’s provider: we do not guarantee delivery, inbox placement or delivery times. We investigate problems reported through our support channels.
9. Migration Assistance
- Scope and preparation: Migration of mailboxes to us, or between platforms, is a project service scoped and priced in your order or quotation. You must provide an accurate inventory, working credentials and the access we need, and keep the source system available until we confirm completion.
- Credentials and results: Credentials must be supplied through our ticket system or another secure channel we provide, not by unprotected means; create a temporary password used only for the migration and reset it once complete. Timeframes are estimates, items a source system will not release cannot be migrated, and you must keep your own copy of the data and check the result promptly.
10. Your Content, Confidentiality and Backups
- Our access to your data: The contents of your mailboxes are your data; we claim no ownership. We access them only so far as is necessary to operate, maintain and secure the service, to carry out a support request, to deal with abuse, or where the law requires it.
- Backups: You must keep your own copies of your mail; we do not warrant backup or restoration of individual messages or mailboxes unless you have ordered a separate backup service.
11. Fees, Renewal, Suspension and Termination
- Fees and renewal: Fees are due in advance, billed recurringly, in United States Dollars. Licences renew unless you cancel before the renewal date; cancellation stops future billing only and no refund is given for unused time, as our Refund Policy sets out.
- Non-payment and termination: If payment is overdue we may suspend or terminate the mailboxes until the balance is paid. On termination the mailboxes are deactivated and the mail they contain may be deleted, so export your mail beforehand; personal and account records are handled as set out in our Privacy Policy.
12. Disclaimers and Exclusions of Liability
- As is: The service is provided as is and as available; we do not warrant that it will be uninterrupted, error-free or secure, except where the specification of the plan you ordered states a specific availability commitment, which then applies to that plan. To the fullest extent permitted by law we are not liable for indirect, incidental, special, consequential or punitive damages, or for mail delayed, rejected, filtered or lost by a third-party network. You indemnify us against claims arising from your use of the service.
- Mandatory rights: Nothing here excludes or limits any right you have under the mandatory consumer protection laws of the United Arab Emirates, or any liability that cannot lawfully be excluded.
